Details Emerge in Attempted Murder Case

Milpitas resident Eric Ericson is expected to enter a plea on April 1 at the Hayward Hall of Justice. He is being held without bail at the Santa Rita jail.

Eric Ericson, a Milpitas resident facing an attempted murder charge after a shooting in the parking lot of a , is expected to enter a plea at his scheduled appearance in court on April 1 at 9 a.m.

The victim, David Wayne Robinett Jr. of San Leandro, survived a gunshot wound. According to the case file, on March 11 around 9 p.m., Ericson arranged to meet Robinett in San Leandro to sell him a half-pound of marijuana.

Robinett and Matthew Adam Madeyski met and spoke with Ericson, according to a police document. Madeyski then grabbed the plastic bag filled with marijuana from Ericson’s vehicle and ran with Robinett, without paying Ericson.

According to the police document, Ericson chased after them and fired a handgun, striking Robinett in the neck once, according to the police document. Robinett broke his jaw but survived. Ericson fled the scene shortly after the shooting and was later arrested by Milpitas SWAT at his home in Milpitas.

The three parties involved and Ericson’s vehicle were all captured on Walmart’s security video. Some of the marijuana was also recovered at the scene.

"I strongly believe there is a self-defense argument in this whole thing," his attorney, Nick Cvietkovich, said in a previous interview.

"It appears to be a drug deal gone bad," said Lt. Jeff Tudor, spokesman for the , shortly after the incident occurred.
