Man Shot At By SJ Police Is Named

Police have identified a man who was arrested after an officer-involved shooting in San Jose on Sunday night as 49-year-old Sergio Angel Arruda.

Arruda, a San Jose resident, was taken into custody after being shot at by police as he allegedly tried to evade officers, police said. He was not hit by the gunfire.

About 8:35 p.m., officers patrolling the Cinco de Mayo festivities near South King and Story roads spotted a Ford SUV that had been involved in an incident at the same intersection 15 minutes earlier in which a gun had been brandished.

When the officers attempted to stop the SUV, the driver sped away and headed north on Interstate Highway 680, police said.

Police located the vehicle a short time later near McKee Road and North Jackson Avenue, where they saw two people getting out of the car.

Officers then saw Arruda and another passenger get out of the car and run into a residential neighborhood in the area of Ashglen and Ridgeglen ways, near Independence High School.

Officer Stanley Gaspar then fired at Arruda after he allegedly ignored Gaspar's instructions to surrender and made threatening gestures with his hands, according to police.

Arruda was not injured and was soon apprehended by Gaspar and another officer. The officers found that Arruda was not armed.

Arruda was booked into Santa Clara County Jail in San Jose on  charges of evading and resisting arrest and driving without a license.

The officer-involved shooting remains under investigation.

The three remaining suspects involved in the incident remain at large, police said.

San Jose police Officer Jose Garcia said he could not comment on the type of threatening hand gesture Arruda had made during the chase.
