Planning Commission Suggests Rejecting 213 High-Density KB Homes

The Milpitas Planning Commission will discuss this at their April 10 meeting.

KB Homes has proposed a plan to transform an industrial area of Bothelo Lane into 213 high-density multifamily homes. 

The project, however, may be rejected by the Milpitas Planning Commission at their April 10 meeting, according to city documents

According to the project proposal, the current site is 16.6 acres where a vacant warehouse building and a contractor's yard sits. The site is considered "heavy industrial" with Union Pacific Railroad to the west of the proposed site.

One of the major downfalls of this project, according to city documents, is its close proximity to the rail yard and "potential negative impacts the yard has on adjacent properties. Potential nuisances as a result of operations at the rail facility are pre-empted by Federal law."

"Staff’s analysis combined with the Draft Environmental Impact Report analysis identifies numerous issues and inconsistencies with the City’s General Plan, Midtown Specific Plan and Zoning Ordinance. Staff recommends the Planning Commission recommend that the City Council deny the project and not certify the Final EIR," according to city documents.

Milpitas Planning Commission meets the second and fourth Wednesdays of the month at City Hall, 455 E. Calaveras Blvd. at 7 p.m. The next meeting, where they will discuss this issue, is set for April 10.
